First Sale Doctrine

Testlab Studio buys genuine, lawfully made products from legitimate retailers and resells them without modification. Under U.S. law this is expressly permitted by the First Sale Doctrine, codified at 17 U.S.C. § 109, which establishes that once a copyrighted work has been lawfully sold, the rights holder's distribution control over that specific copy is exhausted. The Lanham Act (15 U.S.C. § 1125) permits truthful descriptive use of a trademark to identify the resold genuine product. Prestonettes v. Coty (264 U.S. 359) confirms a reseller may repackage and truthfully describe genuine goods. Champion Spark Plug v. Sanders (331 U.S. 125) affirms that reconditioned or resold genuine goods may be sold under their original trademark provided the condition is disclosed.
